Terms of Service

Welcome to LA Sports Massage (referred to as “we,” “us,” or “our”). These Terms of Service (“Terms” or “ToS”) govern your access to and use of our website (the “Site”) and the services provided through it (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

1. ACCEPTANCE OF TERMS By registering for, accessing, or using the Service, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you are using the Service on behalf of an organization or entity, you represent that you have the authority to bind that organization or entity to these Terms.
2. DESCRIPTION OF SERVICE The Service provides a MedSpa service providing medically supported weight loss, health improvement, and recovery support for clients. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we will not be liable to you or any third party for doing so.

USER ACCOUNTS To access certain features of the Service, you must register for an account by providing accurate and complete information, including your email address, and creating a username and password. You are responsible for:Maintaining the confidentiality of your account credentials.All activities that occur under your account. Notifying us immediately at office@lasportsmassage.com if you suspect unauthorized use of your account. We reserve the right to terminate or suspend your account at our discretion, including for violations of these Terms.
4. USE OF THE SERVICE You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

Engage in any activity that disrupts, damages, or impairs the Service, including transmitting viruses, malware, or other harmful code.

This campaign will be used to send appointment reminders and confirmations to customers who have booked appointments with our business through our website. We will collect opt-in consent from customers by requiring them to check a box on our website indicating that they agree to receive appointment reminders and confirmations via text message. Customers will be able to opt out of receiving messages at any time by replying “STOP” to any message they receive.

7. You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages.

8. PRIVACY AND INFORMATION USE Your use of the Service is also governed by our Privacy Policy, available at lasportsmassage.com/privacy-policy. We do not share your personal information with third parties for marketing or promotional purposes. Specifically, no mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Please review the Privacy Policy for details on how we collect, use, and protect your information.

9. INTELLECTUAL PROPERTY Our ContentAll content, features, and functionality of the Service, including text, graphics, logos, software, and design elements (collectively, “Our Content”), are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of Our Content without our prior written consent.

Your ContentYou retain ownership of any content you submit or upload to the Service (“Your Content”). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, store, and display Your Content solely to provide and improve the Service. You represent that you have the rights to grant this license.

10.TERMINATION We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violations of these Terms. Upon termination, your right to use the Service will cease immediately. Sections 6 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Governing Law) will survive termination.

DISCLAIMERS The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. LIMITATION OF LIABILITY To the fullest extent permitted by law, LA Sports Massage, its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service will not exceed $100.

INDEMNIFICATION You agree to indemnify, defend, and hold harmless LA Sports Massage, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

14.CHANGES TO THE TERMS We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on the Site or sending a notice to the email address associated with your account. Significant changes will take effect 30 days after notification. Non-material changes will take effect immediately. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

15.GOVERNING LAW These Terms and your use of the Service are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you consent to the jurisdiction of such courts.

16. MISCELLANEOUS Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: You may not assign these Terms or your rights under them without our prior written consent. We may assign these Terms at our discretion.14.
